Welcome to Dreemy AI. These Terms of Service ("Terms") govern your access to and use of our AI-powered platform. By using our Services, you agree to comply with these Terms. If you do not agree, you must stop using the Services immediately.

1. Access & Eligibility

1.1 Age Requirement

You must be at least 18 years old to use Dreemy AI. Our services involve generative content that is strictly for adults. By accessing the site, you represent and warrant that you meet this age requirement and are of legal age in your jurisdiction.

1.2 Account Security

You are responsible for all activity that occurs under your account credentials. You agree to notify us immediately of any unauthorized use of your account. You may not share your account with third parties.

1.3 Geographic Restrictions (China & Hong Kong)

The Services are strictly prohibited for use by individuals located in, residing in, or citizens of Mainland China and the Hong Kong Special Administrative Region (SAR). By accessing the Services, you represent and warrant that you are not located in or accessing the platform from these restricted regions. We reserve the right to implement technical measures (such as IP blocking) and immediately terminate any accounts found to be in violation of this geographic restriction without prior notice or refund.

2. Prohibited Content & Safety Policy

Dreemy AI supports creative freedom, but we have zero tolerance for malicious, harmful, or abusive content. You explicitly agree NOT to use the Service to create, upload, disseminate, or generate:

Harm to Others (Defamation & Bullying): Content intended to defame, mock, bully, or cause psychological, emotional, or reputational harm to any individual or group. The creation of content used for malicious impersonation, blackmail, or intimidation is strictly forbidden.
Hate Speech & Discrimination: Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or disability.
Child Exploitation: Any content depicting, promoting, or resembling Child Sexual Abuse Material (CSAM) or the sexualization of minors.
Non-Consensual Sexual Content (NCSC): Realistic depictions of real individuals (e.g., Deepfakes) without their explicit consent.
Privacy Violations: Content that doxes, reveals private/identifying information, or is used to stalk or harass individuals.
Violence & Illegal Acts: Content promoting self-harm, suicide, terrorism, extreme gore, or facilitating illegal activities.

Violation of this policy will result in immediate account termination, a permanent ban without refund, and potential reporting to law enforcement authorities where applicable.

3. Intellectual Property

3.1 Ownership

You retain ownership of the prompts you input and the unique content generated by the AI ("Generations"), subject to your full compliance with these Terms.

3.2 Platform License

By using the Service, you grant Dreemy AI a non-exclusive, worldwide license to host, store, and display your content strictly as necessary to operate, secure, and improve the Service.

3.3 Content Public Visibility

Our service allows you to generate videos, images, or other creative content (“Generated Content”) based on the materials you upload or submit (“User Submissions”). You may choose to make your Generated Content public. When you set your Generated Content to public, you grant us and our affiliated companies a perpetual, non-exclusive, transferable, sublicensable, royalty-free, irrevocable, worldwide license to use, display, download, modify, distribute, and create derivative works from your content.

This license applies to all current and future online media and channels, including but not limited to:

Improving, optimizing, or training artificial intelligence models;
Promoting, distributing, or displaying all or part of the services and their derivative works through any media or channels;
Creating derivative assets or works based on your instructions or Generated Content.

4. Subscriptions & Payments

4.1 Fees

Services are offered on a subscription basis. You agree to pay all applicable fees upfront upon purchase.

4.2 No Refunds

Due to the high cost of GPU computing required for AI generation, all payments are non-refundable unless required by applicable mandatory consumer laws in your jurisdiction.

4.3 Cancellation

You may cancel your subscription at any time via your account settings to prevent future renewal charges. You will retain access to the Service until the end of your current billing cycle.

5. Disclaimers & Liability

5.1 Service "As Is"

Dreemy AI provides the service on an "as is" and "as available" basis. We do not guarantee that AI generations will be accurate, consistent, uninterrupted, or meet your specific expectations.

5.2 Limitation of Liability

To the fullest extent permitted by law, Dreemy AI, its affiliates, and its founders shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Service.

6. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in Hong Kong.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notifications. Your continued use of Dreemy AI after such changes constitutes your acceptance of the revised Terms.
